Liability Waiver & Assumption of Risk

1. Parties

This Liability Waiver and Assumption of Risk applies between you, the user, client, rider, student, purchaser, or participant ("you" or "Participant"), and MOTO LAND ("Company," "we," "us," or "our").

This Waiver applies to all MOTO LAND digital courses, online coaching sessions, video reviews, written feedback, downloadable materials, riding analysis, educational content, communications, and any related services.

2. Voluntary Participation

You acknowledge that your participation in MOTO LAND services is voluntary. You choose whether to access our materials, submit riding footage, schedule coaching, apply techniques, perform drills, ride a motorcycle, participate in track days, or practice any concept discussed in our content.

You understand that MOTO LAND does not require you to perform any riding activity and does not supervise your riding in person.

3. Assumption of Risk

You understand and acknowledge that motorcycle riding is inherently dangerous and may result in serious injury, permanent disability, paralysis, death, property damage, emotional distress, financial loss, or third-party claims.

Risks may arise from, among other things:

• Your own riding decisions, errors, reactions, judgment, or skill level;
• Actions or negligence of other drivers, riders, pedestrians, track users, or third parties;
• Road conditions, track conditions, weather, traffic, visibility, debris, gravel, oil, animals, or unexpected hazards;
• Mechanical failure, tire failure, brake failure, suspension issues, or improper motorcycle maintenance;
• Improper use of techniques, drills, body position, throttle, brakes, vision, cornering line, or lean angle;
• Failure to wear appropriate protective gear;
• Physical fatigue, distraction, impairment, fear, panic, overconfidence, or mental pressure.

You voluntarily assume all risks associated with motorcycle riding and with your use or attempted use of any educational information provided by MOTO LAND.

4. Online Education Only

MOTO LAND provides online educational content and remote coaching. We do not provide emergency response, in-person instruction, on-road supervision, mechanical inspection, medical evaluation, licensing approval, insurance advice, or legal permission to operate a motorcycle.

Any feedback we provide is based only on the information available to us, such as submitted video footage, written descriptions, or online discussion. We may not see all relevant hazards, conditions, rider inputs, motorcycle issues, or environmental factors.

5. Participant Responsibilities

You agree that you are solely responsible for:

• Riding safely, legally, and within your ability;
• Maintaining valid licensing, registration, insurance, and legal authorization to ride;
• Selecting safe and lawful practice locations;
• Wearing proper motorcycle protective equipment;
• Ensuring your motorcycle is properly maintained and safe to operate;
• Following all traffic laws, track rules, event rules, organizer instructions, and safety requirements;
• Stopping any activity that feels unsafe or beyond your skill level;
• Seeking in-person professional instruction where appropriate.

6. Release of Liability

To the fullest extent permitted by applicable law, you agree to release, waive, discharge, and hold harmless MOTO LAND, its owners, instructors, contractors, affiliates, representatives, service providers, successors, and assigns from any claims, demands, damages, losses, liabilities, costs, expenses, injuries, death, property damage, or causes of action arising out of or related to:

• Your use of MOTO LAND content or services;
• Your motorcycle riding activities;
• Your application or attempted application of any technique, drill, recommendation, or feedback;
• Your participation in road riding, track riding, racing, practice, training, or related activity;
• Your failure to ride within your ability or comply with safety obligations;
• Any crash, collision, injury, death, or property damage connected to your riding decisions.

Nothing in this Waiver is intended to limit liability where such limitation is prohibited by law.

7. No Warranty or Guarantee

MOTO LAND makes no warranty or guarantee that our services will improve your riding, prevent accidents, eliminate risk, increase safety, reduce fear, improve lap times, prevent injury, or produce any specific riding outcome.

All services are provided on an educational basis and are used at your own discretion and risk.

8. Indemnification

You agree to indemnify, defend, and hold harmless MOTO LAND and its owners, instructors, contractors, affiliates, representatives, and service providers from and against any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorney fees, arising from:

• Your breach of this Waiver or our Terms of Service;
• Your misuse of our content or services;
• Your riding activities or riding decisions;
• Your violation of laws, rules, regulations, track policies, or third-party rights;
• Any claim brought by a third party related to your motorcycle operation or conduct.

9. Minors

MOTO LAND services are intended for adults who are legally permitted to enter into binding agreements. If a parent or legal guardian allows a minor to view or use MOTO LAND materials, the parent or guardian assumes full responsibility for the minor's access, conduct, riding decisions, and safety.

10. Severability

If any part of this Waiver is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.

11. Acknowledgment

By accessing or using MOTO LAND services, you confirm that you have read this Liability Waiver and Assumption of Risk, understand its meaning, understand that motorcycle riding involves serious risks, and agree to be bound by its terms.
