Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, online programs, video content, coaching services, and all related materials provided by MOTO LAND ("Company," "we," "our," or "us"), accessible at this domain. By purchasing, enrolling in, or accessing any course or service offered by MOTO LAND, you ("User," "Client," or "you") agree to be legally bound by these Terms in their entirety.

If you do not agree with any provision of these Terms, you must not access or use our services. We reserve the right to modify these Terms at any time. Continued use of our services following any modification constitutes your acceptance of the revised Terms.

1. Nature of Services

MOTO LAND provides online educational content focused on motorcycle riding technique, physical control, mental preparation, and safety awareness. Our services include, but are not limited to:

  • Pre-recorded online course modules and video lessons accessible through our platform;
  • Live and recorded one-on-one or group coaching sessions conducted via video conferencing platforms;
  • Online Riding Mistake Review: a service wherein clients submit personal riding footage for instructor analysis, annotation, and written feedback;
  • Educational written materials, downloadable guides, drills, and supplementary reference documents;
  • Community access where provided as part of a specific program package.

All services are educational in nature. MOTO LAND does not provide physical on-site instruction, guided rides, or any form of in-person accompaniment. All practical application of the techniques taught is performed solely by the client, at their own discretion and risk.

2. Eligibility and Registration

To access MOTO LAND services, you must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater. By registering, purchasing, or using our services, you represent and warrant that you meet this requirement.

You agree to provide accurate, complete, and current information when creating an account or submitting a service request. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

MOTO LAND reserves the right to suspend or terminate your account if we have reason to believe that the information you have provided is inaccurate, incomplete, or in violation of these Terms.

3. Purchases and Payment

All prices listed on the MOTO LAND website are denominated in United States Dollars (USD). Prices are subject to change without prior notice, though changes will not affect orders already completed.

Payment is processed at the time of purchase. We accept the payment methods displayed at checkout. You agree to pay all charges at the prices listed for the services you purchase, including any applicable taxes or fees.

Recurring subscriptions, if offered, will be billed according to the schedule agreed upon at the time of enrollment. You may cancel a subscription at any time, subject to the Refund Policy outlined in our separate Refund Policy page.

4. Course Access and License

Upon successful payment, MOTO LAND grants you a limited, non-exclusive, non-transferable, revocable license to access and use the purchased course materials for your personal, non-commercial educational purposes only.

This license expressly prohibits:

  • Sharing, reselling, sublicensing, or redistributing course content in any form;
  • Recording, screenshotting, or reproducing video lessons or written materials without express written consent;
  • Using MOTO LAND content to create competing educational products or services;
  • Uploading MOTO LAND content to any third-party platform, including YouTube, social media, or file-sharing services;
  • Providing access to your account to any person other than yourself.

MOTO LAND retains all intellectual property rights in and to all course content, video materials, written guides, brand assets, and instructional methodologies. These Terms do not transfer any ownership rights to you.

5. Intellectual Property

All content published by MOTO LAND — including but not limited to text, video recordings, graphics, logos, course structures, and proprietary teaching methodologies — is the exclusive intellectual property of MOTO LAND and is protected under applicable copyright, trademark, and trade secret laws.

The MOTO LAND name, logo, and all associated trade dress are proprietary marks of the Company. You may not use these marks in any manner without prior written permission from MOTO LAND.

6. User Conduct

By using our platform and services, you agree not to:

  • Engage in any conduct that is unlawful, harmful, threatening, abusive, harassing, or defamatory;
  • Attempt to gain unauthorized access to any portion of the platform or its related systems;
  • Use automated scripts, bots, scrapers, or other tools to collect data from the platform;
  • Submit false, misleading, or fraudulent information in any form, including in video submissions for the Mistake Review service;
  • Interfere with or disrupt the integrity or performance of the platform or its services;
  • Violate the rights of any third party, including intellectual property rights and privacy rights.

7. Submission of Riding Footage

When you submit riding footage as part of the Online Riding Mistake Review service, you grant MOTO LAND a limited, royalty-free, worldwide license to view, analyze, annotate, and retain that footage for the purpose of providing the requested service.

MOTO LAND will not publish, share, or distribute your submitted footage to any third party without your explicit written consent, except as required by law. You represent that you own or have the right to submit all footage provided and that its submission does not infringe any third-party rights.

You acknowledge that MOTO LAND's analysis of your footage constitutes educational feedback only. It does not constitute a guarantee of safety, a professional safety certification, or a warranty that techniques demonstrated or corrected will prevent accidents or injury.

8. Disclaimer of Warranties

MOTO LAND services are provided on an "as is" and "as available" basis, without any representation or warranty of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, secure, or free of viruses. We do not warrant that the educational content will achieve any particular result in your riding ability, safety outcomes, or performance.

9. Limitation of Liability

To the maximum extent permitted by law, MOTO LAND, its instructors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services or any action you take on a motorcycle as a result of information received through our programs.

In no event shall our total aggregate liability to you for any claim arising out of or relating to these Terms or our services exceed the amount you paid to MOTO LAND in the twelve (12) months immediately preceding the claim.

You understand and acknowledge that motorcycle riding is an inherently dangerous activity. MOTO LAND's content is educational in nature, and you assume full and sole responsibility for any action taken on a motorcycle. See our Riding Safety Disclaimer and Liability Waiver for additional detail.

10. Indemnification

You agree to indemnify, defend, and hold harmless MOTO LAND and its instructors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any injury, accident, or damage caused or contributed to by your riding activity.

11. Termination

MOTO LAND reserves the right to suspend or terminate your access to any or all services at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, instructors, or third parties, or is otherwise objectionable.

Upon termination, your license to access course materials is revoked. You will not be entitled to a refund except as provided in our Refund Policy in cases where termination is not due to your breach of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or our services shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved informally within thirty (30) days, it shall be submitted to binding arbitration in Castle Rock, Colorado, in accordance with the rules of the American Arbitration Association.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of our services after any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Riding Safety Disclaimer, and Liability Waiver, constitute the entire agreement between you and MOTO LAND with respect to your use of our services and supersede all prior and contemporaneous agreements, representations, and understandings.
